Fuel Finder Privacy Statement

1. Introduction

Exxon Mobil Corporation and its affiliated companies (“ExxonMobil”) appreciate your interest in the Fuel Finder Application (“App”) and Website (“Site”). Your privacy is important to us and we want you to know what information, including Personal Information, we collect about you and how we use that information. Personal Information is information that could identify a specific individual, including names, addresses, e-mail addresses, and telephone numbers.

Personal Information collected through the App and the Site is controlled by Exxon Mobil Corporation and its affiliated companies.

3. Your Personal Information

3.1 We collect the following information through the App:

i. ExxonMobil collects information, including Personal Information, about users of the App; this information includes your geographic location and exact positioning, the operating system of your device, the type of device you use, the IP address of your device, and information about the way you use the App (“Device Information”).

ii. In addition, ExxonMobil records information about the settings of the App. You may be allowed to save certain settings in the ExxonMobil App manually, including your country of residence, your preferred language, your preference regarding kilometers or miles, your favorite Exxon, Mobil, and Esso service stations, and other settings (“User Settings”).

iii. The App also allows you to enter, post, submit, or link to certain content, such as comments, ratings, and reviews (“User Content”).

3.2 We collect the following information through the Site:

i. When someone visits the Site, our web servers automatically gather information that allows the Site to communicate with the visitor’s computer during the visit. We also track such information as the number of visits to the Site, which parts of the Site visitors select, IP address (the Internet address assigned to your computer from your Internet Service Provider), domain type, browser type (e.g., Firefox, Chrome or Internet Explorer), session start and stop times, date and time of day. This information is included in the defined term “Device Information”.

ii. We also record User Content if you choose to provide that through the Site.

4. Our Use of Your Personal Information

ExxonMobil uses the Device Information, User Settings, and User Content for the purpose of:

i. advising you about nearby Exxon, Mobil and Esso service stations,

ii. providing you with more customized services to improve your experience while using the App or Site (for example, the App may use Device Information to set certain settings automatically, such as your country of residence and your local language),

iii. allowing ExxonMobil to collect aggregated and anonomysed data about the use of the App and the Site in order to gain insight in the use, popularity and usability of (sections of) the App and the Site,

iv. generally improving our products, services and information technology offerings.

The App collects data about your geographic location and positioning only when the App is open and activated; location data is not otherwise collected by the App.

We retain the Personal Information you provide for the duration of the services we provide to you and for as long as is necessary to provide support-related reporting and trend analysis.

If during your visit you personalize the App or the Site, complete an order form, enter a contest, or submit other information to us, you are expressly and voluntarily accepting that we will use that information to provide you with products or services, to bill you for products and services you request, to tell you about ExxonMobil products and services which we think may be of interest to you, or to communicate with you for other purposes.

5. Marketing and promotions use

ExxonMobil may use the information it collects from your device, using the App or the Site, to (i) offer contests and promotions to you and (ii) market various products and services to you. If you no longer wish to receive our information about promotions and marketing activities, contact us at:

ExxonMobil does not sell or distribute your information to third parties for purposes of allowing them to market their products and services to you.

6. Files or Code Placed on Your Mobile Device or Computer

6.1 We may store files or code (“trackers”) on your device when you visit the Site or use the App. Through these trackers, ExxonMobil accesses data stored on the device (Device Information, User Content and/or User Settings). These trackers help us to provide our services to you, help us to customize your use of the App and the Site, and help us to obtain analytical information about the use of the App and Site, as explained in section 4.

We receive the information collected by the trackers in an aggregated and de-personalized form, meaning that we cannot identify you when we receive the data.

6.2 The trackers that are used when you access our Site (commonly referred to as “cookies”) can be blocked or erased from your device. A “cookie” is a file in which we store certain user information which is re-used when you return to the Site. You can deactivate the cookie function in your internet browser (the ‘help’ screen in your internet browser should tell you how to do this). 6.3 Some of the trackers that are used when you use our App can be disabled (such as with Flurry Analytics, discussed below); however not all of these trackers can be blocked or erased. Your acceptance of the Terms of Use Agreement and Privacy Statement indicate that you accept that trackers are placed onto your device, and that trackers read your device and transfer information about you and your device to ExxonMobil or to third parties.

6.4 The App and Site contain various third party software components and services; these third party software components and services rely on cookies and/or code installed onto your device to access data stored on your device, which is used by ExxonMobil for statistical and analytical purposes.

This technology will not allow ExxonMobil to personally identify you. All information provided to ExxonMobil by these third parties will be in anonymized and aggregated form.

7. Hyperlinks

The Site and the App contain links to sites (e.g. Facebook and Twitter) that ExxonMobil does not own, control or maintain. We cannot be responsible for their privacy policies and practices and we make no representations or warranties about the privacy practices of those sites. Similarly, we cannot be responsible for the policies and practices of any site from which you linked to our Site. We recommend that you check the privacy policy of these other sites and contact the operator if you have concerns or questions.

8. Sharing Information with Affiliates

Personal Information collected by ExxonMobil may be transferred among its various divisions and affiliates, around the world. By accepting the Terms of Service and the Privacy Statement, you explicitly consent to these transfers.

9. Sharing information with Third Parties

Communicating via the Internet and sending information, products, and services to you by other means necessarily involves your information passing through or being handled by third-parties.

10. Data Transfers

We may transfer the Personal Information we collect about you to countries other than the country where the information was originally collected. Those countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer your information to other countries, we will protect that information as described in this Privacy Statement.

If you are located in the E.E.A. or Switzerland, we comply with applicable legal requirements providing adequate protection for the transfer of Personal Information to countries outside of the E.E.A. or Switzerland. We have in place measures to ensure that recipients of Personal Information provide adequate protection to your information; these measures include, amongst others, contractual obligations for recipients to handle and protect the personal data in accordance with standard contractual clauses developed by the European Commission.

11. Sensitive Information

ExxonMobil does not seek any sensitive information from visitors to our Site or users of our App, unless legally required to do so, for example, in connection with recruiting or hiring. Sensitive information includes a number of types of data relating to: race or ethnic origin, political opinions, religious or other similar beliefs, trade union membership, physical or mental health, sexual life or criminal record. We suggest that you do not provide sensitive information of this nature. However, if you do provide such information, ExxonMobil accepts your explicit consent to use that data in the ways described in this Privacy Statement or in the ways described at the point where such information is disclosed.

12. Opt Out/Modify Information

You can request the removal or modification of your Personal Information by sending an e-mail to the Data Privacy Office. We will then make a reasonable effort to accommodate your request. It would be helpful to let us know the context in which you provided Personal Information.

If you are resident in a country with comprehensive data privacy laws, you have certain rights in relation to the information we collect, including the right to know what Personal Information we process, to have your Personal Information corrected and updated, and to withdraw your consent to the processing of your Personal Information.

13. Your California Privacy Rights 

California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year.  We do not share personal information with third parties for their own direct marketing purposes.  Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates.  Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them.  Because there currently is no industry standard concerning what, if anything, websites should do when they receive such signals, the Services currently do not take action in response to these signals.  If and when a final standard is established and accepted, we will reassess how to respond to these signals.

14. Conditions of Use, Notices and Revisions

If you choose to visit our Site or use our App, any dispute over privacy is subject to this Privacy Statement and the Terms of Use Agreement, including any limitations on damages and application of law provisions. We reserve the right to change this statement at any time without notice.

When we make material changes to this Privacy Statement, we will post the changes on this page and update the revision date at the top of the Privacy Statement. We encourage you to view our Privacy Statement regularly for updates. If you agree to the changes, simply continue to use our App or visit our Site. If you object to any of the changes to our terms, you are free to stop using our services and delete the App.
